The terms “We” / “Our” / Us, “Website”, individually and collectively refer to Kitabyana Inc., a website owned and maintained by Kitabyana for Personalized Products Inc. This page states the Terms and Conditions under which “you”, (Visitor), may visit and use this website (“Website”). Please read this page carefully. If you do not accept the Terms and Conditions stated here, we would request you to exit this site. Kitabyana for Personalized Products Inc., any of its business divisions and / or its subsidiaries, associate companies or subsidiaries to subsidiaries or such other investment companies (in Canada or abroad) reserve their respective rights to revise these terms and conditions at any time by updating this posting. You should visit this page periodically to re-appraise yourself of the Terms and Conditions, because they are binding on all users of this Website.

Cancellation, refund, and delivery policy

Within 12 hours of placing your order, you can apply for order amendment. Unfortunately, we can’t give you a refund, but we’ll give you a coupon for the same amount so you can resubmit your order with changes. You’ll get the coupon in your email within 2 business days.

After 12 hours, we can’t accept cancellations or modifications. Printed customized books or products cannot be refunded or cancelled.

Replacing policy

Our number one goal is complete customer satisfaction, so we make sure our products go through quality testing. In the unlikely event that you get a damaged product, we’ll replace it. If this happens, please let us know within 24 hours, customers@kitabyana.com.

Methods of shipping

Shipping partners will do their best to deliver on time. However, sometimes things get delayed. Shipping delays caused by weather, shipper errors, or other reasons outside our control aren’t our responsibility. 

Once your order is placed, we’ll give you a tracking number. In the case of a claim of non-delivery, we can’t issue a refund when tracking information shows that the shipment was delivered to the same address.

We ship through a third-party courier. The total price of the book includes delivery. To deliver the order, our shipping partner will call you twice. In this case, your book is returned to us, and we have to charge you additional shipping fees for resending it to you.


Please provide us with a correct mobile number and physical or mailing address.

Payment methods and pricing

Prices are subject to change at any time.

When you place your order, you’ll have to pay through our payment gateway provider. Once payment is made in full, the Contract is in force. Payment details will need to be submitted to the third-party payment gateway provider, and you may also have to agree to additional terms and conditions. We can’t accept, and hereby exclude, any liability arising out of or in connection with your use of third-party payment providers.

All the details you provide to our website for your Order and its delivery are true and accurate. Additionally, the chosen method of payment belongs to You, and sufficient funds or credit facilities are available to cover the order.

The use of content

In this site, all logos, brands, illustrations, stories, text, marks, content, headings, labels, names, signatures, numerals, shapes, or combinations thereof are either owned or used under licence by Kitabyana Inc. This Website features the brands, illustrations, stories, text, marks, content, headings, labels, names, signatures, numbers, shapes, etc. Except as provided in these terms and conditions or in the site content, you can’t use these properties or any other content on this site. Without the written permission of the respective company or entity, you may not sell, modify, reproduce, display, publicly perform, distribute, or otherwise use the content of this Website. It’s not allowed to reproduce, photocopy, record, scan, store, or transmit any part of this publication without the prior permission from Kitabyana Inc. Anyone who does any of those things will be held accountable.

Usage guidelines for the website

The liability

User agrees that neither the website nor its group companies, directors, officers or employees will be held responsible for any direct or indirect or / and incidental or / and special or / and consequential or / and exemplary damages, resulting from the use or / and the inability to use the service or / and for procurement costs In the event that any substitute goods or services are purchased or obtained, or if any messages you receive or transactions you enter into through or / and from the service or / or resulting from unauthorized access to or alteration of the user’s transmissions or / and data or / or any other matter relating to the service, including, but not limited to, loss of profits or / and use or / and data or other intangible, even if Kitabyana Inc. has been advised of the possibility of such damages. A user agrees that the website won’t owe him or her any damages if the service gets interrupted, suspended or canceled, including direct or indirect, incidental or / and special or / and consequential or / and exemplary damages, no matter whether the interruption or suspension or termination was justified or not, negligent or intentional, inadvertent or intentional. Kitabyana Inc. reserves the right to use the customization data provided by the user for marketing. The user acknowledges that Kitabyana Inc. isn’t responsible for any third-party statements or conduct. Company’s total liability to the User cannot exceed the amount paid by the User to Kitabyana Inc. for all damages, losses, and causes of action.

Payments

Orders go into effect when the user places the order (Personalized book/s and product/s) and receives our confirmation email with the payment receipt. For their records, the user needs to keep a copy of the transaction. Users give the company permission to verify and process their orders, including their payment method and charging their credit cards. On the website, each order will be treated separately and autonomously. Users’ data and payment card details will be shared with a third party payment processor and fraud prevention partner. Promotions and special offers for pricing are provisional, and the website reserves the right to change or discontinue them at any time. Currently, we accept Visa and MasterCard through a third-party gateway provider and PayPal. USA Dollars will be used for payments and transactions.

The color disclaimer and the book specs

Because of the backlit screen, the colors look brighter and more vibrant. Although Kitabyana Inc. makes every effort to match the colors of the virtual book, it can’t guarantee it.

Our printing is done by third-parties in different countries. It’s important to note that printing specs vary from printing house to printing house. Orders aren’t guaranteed to have the same specifications.

Compliance

Our company is registered in Canada and complies with all laws, rules, and regulations. This included export laws, privacy laws, taxes, and data protection laws. As required by law, we’ll cooperate with local, federal, and international governments.

Privacy protection

You may give us information when you use the Website. By visiting the Website, you give us permission to use your information in Canada and anywhere else we operate. Our Website may get information from external applications you use. We may also get info from various web technologies, like cookies, log files, clear gifs, and web beacons.   • Purchases, disputes, or claims arising out of or in connection with this website are governed by Canadian law.
  • At the checkout page, you’ll see the same price and currency as on the Transaction Receipt, and the amount charged to the card will be in your card’s currency.
  • We won’t trade with or provide services to sanctioned countries.
  • Website users under 18 years old aren’t allowed to register as Users or transact on or use the website.
  • It’s the user’s responsibility to keep his account confidential.
  • When you buy a physical good, we need your email address, shipping address, and billing info. For any reason, including errors in the information you provide, we can reject or cancel an order.
  • We reserve the right to change prices and features at any time.
  • Our Services (or any part thereof) and/or Products may be modified, discontinued or suspended, temporarily or permanently, with or without notice. Any modification, discontinuance, or suspension of any of the Services or Products won’t make us liable to you or to any third party.
